General Sales Conditions

The Préférence Gift Boxes are marketed by Hôtels & Préférence, a limited liability company with a share capital of €7,622.45, having its registered office at 9, rue des Grands Champs, 75020 Paris, France, Paris Companies Registration Office nr. B 424 989 549 and Intra-Community VAT nr. FR 774 249 895 49. These general sales conditions (GSC) apply to the sales of Préférence Gift Boxes. The business relationship between Hôtels & Préférence and the customer is subject to the GSC, which the purchaser accepts without reserve. The conditions may not be changed at any time without the written agreement of the parties.

The parties:

  • Customer: the person who has ordered and paid for a Préférence Gift Box
  • Beneficiary: the person who makes use of the Préférence Gift Box; it may be the customer himself
  • The hotel: the hotel, selected by Hôtels & Préférence, which provides the services offered in the Préférence Gift Boxes.

Article 1 - Application of the GSC

The act of placing of an order for a Préférence Gift Box implies prior acceptance of these GSC. Accordingly, the customer accepts being perfectly aware of the fact that his agreement in relation to the contents of these GSC does not require this document to be signed by him, insofar as the customer wishes to order said products online. The customer may save or consult these GSC, it being understood that the saving or consulting of this document is his/her own responsibility; the contents of these general sales are subject to change. Given which, the conditions that are applicable at the date of the order are those in force on the www.hotelspreference.com website.

Article 2 - Price, Terms of Payment and Production

The prices are given in Euros and include all taxes; full payment must be made at the time of ordering. They do not include any shipping or handling charges (8%, including all taxes). These costs are charged separately and are shown before the final validation of the order. An invoice will be issued and the order processed once full payment has been received. The Préférence Gift Boxes will be made up as per the customer's instructions. The message is printed at the responsibility of the customer. The delivery date is to be calculated from the date of receipt of payment. We shall not be held responsible for any delay in delivery in the event that we have not received the payment by credit card or cheque.

Article 3 - Tax Regulations Applicable to Préférence Gift Boxes

The customer is informed that Préférence Gift Boxes are considered to be a means of payment. As such, they are exempt from Value Added Tax (VAT) in line with Article 261C of the General Tax Code. The public sales price of a Préférence Gift Box therefore corresponds exactly to the face value of the Préférence Gift Box in question.

Article 4 – Charges and Method of Delivery

Every order validated by the customer before 3 p.m. is processed the same day. Every order validated by the customer after 3 p.m. is processed the next day. Delivery takes place after full payment of the price has been received. The order may be sent, at the customer's choice and expense, to his personal address or directly to the beneficiaries named by him. It is up to the customer to check the state of packing of the goods upon delivery, and to report any shipping damages on the delivery note as well as to Hôtels & Préférence within 48 hours. Deliveries usually take 24 - 96 hours in Metropolitan France depending on the type of delivery selected.

  • • Colissimo Option (€ 6.00 incl. taxes):
    The Colissimo allows parcels to be delivered to anywhere in French territory within 48 - 72 working hours from dispatch, depending upon the area in which the customer's address is situated. This information communicated by Colissimo is given to the customer for information purposes only, without the liability of Hôtels & Préférence being engaged. However, in the event of a noticeable delay, Hôtels & Préférence undertakes to do all it can to follow up the matter and rectify any problems in relation to the shipping for which it is responsible.
  • Chronopost Option (€ 30.00 incl. taxes):
    The Chronopost service allows parcels to be delivered to anywhere in French territory within 24 working hours from dispatch. This information communicated by Colissimo is given to the customer for information purposes only, without the liability of Hôtels & Préférence being engaged. However, in the event of a noticeable delay, Hôtels & Préférence undertakes to do all it can to follow up the matter and rectify any problems in relation to the shipping for which it is responsible.

Article 5 - Loss or Theft - Return of Goods

Hôtels & Préférence may not be held liable in any way whatsoever in the event of loss or theft of Préférence Gift Boxes after they have been delivered to the customer.

Article 6 - Exercise of the Right of Withdrawal

At the time of purchase of a Préférence Gift Box, in accordance with the provisions of Article L 121-20 of the Consumer Code, the customer has period of 7 clear days to exercise his right of withdrawal without having to give any reason or pay any penalties, except, if applicable, the return charges. The period referred to above starts from the receipt of the Préférence Gift Box(es). The return charges are to be borne by the customer. The return is only accepted on condition that the Préférence Gift Box(es) in question be returned completely intact (box, instructions, gift card and message). It is expressly stated that, to be accepted, any return must have been the subject of a prior request to Hôtels & Préférence customer service. Any return carried out in accordance with the conditions of this article will give rise to a reimbursement within 30 days at most. Beyond 7 days, the customer may request an exchange (see Article 13.9).

Article 7 - Customer Service

All queries in relation to information and clarification should be addressed to Hôtels & Préférence, by telephone at + 33 (0)1 78 94 90 40, Monday - Friday, from 9 a.m. to 6.30 p.m., except for public holidays, by e-mail: contact [at] hotelspreference [dot] com , or by post to Hôtels & Préférence, service Préférence Gift Boxes, 9 rue des Grands Champs, 75020, Paris.

Article 8 - Exchange of Préférence Gift Boxes:

The customer and/or beneficiary may, if they so desire, exchange their Préférence Gift Box(es) by contacting the Conciergerie of Hôtels & Préférence directly at +33 (0)1 78 94 90 40.
The fee for exchanging a Préférence Gift Box is €50. In addition to this fee, you will also be asked to meet the cost of shipping.

Article 9 – Terms for Using the Préférence Gift Boxes

These GSC apply to all sales by Hôtels & Préférence to customers in relation to Préférence Gift Boxes:

  • They may not, under any circumstances, be exchanged for money, either in whole or in part thereof.
  • They are the entire responsibility of the beneficiary, in particular in the event of loss or theft.
  • They must be used within their period of validity. Once the expiry date is passed, they may not be refunded, used or exchanged.
  • Their period of validity is one year from the date of activation.
  • • They are valid in a select number of member hotels of Hôtels & Préférence, the list of which is updated annually and may be consulted on the website: www.coffretpreference.com; page: Participating hotels.

The Préférence Gift Cards in €uros: may only be exchanged for a service of an equivalent value to that shown in Euros. To be accepted at an establishment, the beneficiary must reserve a room for one or two people for at least one night. It may be used once or several times to pay for services. Other means of payment may be used to pay any remaining difference, if necessary.

Articles 10 - Reservation and Use Conditions

The beneficiary, to whom a Préférence Gift Box is given along with a list of participating hotels or who consults the website www.coffretpreference.com, should contact Central Reservations to make a reservation. The participating hotel is solely and exclusively responsible for the dates during which it accepts reservations of packages, depending upon its availability. Hôtels & Préférence may not be held liable in relation to dates on which the hotel is closed; the latter may decide to suspend the use of Préférence Gift Boxes during weekends or during a particular season.

Gift Card and Invitation Card: To be accepted at an establishment, the beneficiary must reserve a room for one or two people for at least one night. If the total cost of the reservation exceeds the amount on the card, the customer will be asked to give a credit card number to guarantee the reservation.

Cancellation of stay: The beneficiary may cancel his stay up to 48 hours prior to his arrival date. In the event of a no-show or a late cancellation, the beneficiary loses the right to use the card, with any additional sums being charged to the credit card used to guarantee the reservation.

Article 11 - Data Protection

Personal information given by the customer are not shared with third parties; they are, unless the customer explicitly objects, incorporated into the customer file of Hôtels & Préférence, which has been declared to the Commission Nationale Informatique et Libertés (CNIL - French Data Protection Authority). In accordance with the Law 78-17 of 6 January 1978, the customer has the right to access and change any data relating to him. To exercise this right, he has only to contact the Customer Service of Hôtels & Préférence.

Article 12 - Intellectual Property

The elements that make up the Préférence Gift Box offers, in the form of written text, photographs, images, symbols, sounds, and databases, are the sole and exclusive property of Hôtels & Préférence. It is strictly prohibited to reproduce, represent, change, transmit, publish or adapt using any means whatsoever, or to exploit in any way, all or part of the elements referred to above without the prior written authorisation of Hôtels & Préférence.

Article 13 - Assignment of Jurisdiction

These general conditions as well as the contract concluded at the time of placing an order for a Préférence Gift Box are solely subject to French Law. Any dispute in relation to the interpretation of these general conditions, as well as of the contract, fall within the exclusive competence of the French courts. However, in the event of difficulties or disagreement between the parties in relation to the interpretation, execution or the termination of this contract, the parties agree to seek an amicable solution prior to any legal action.
